Australian child support act


There are some laws regarding child support in Australia. These laws are provisions for child support in different situations. These are also termed as Australian child support acts. Some of the Acts dealing with child support in Australia are discussed below.

Child support assessment Act of 1989

This act came into existence in the year 1989. There are provisions in this act that are related to the child support paid by the parents for the child involved in divorce. According to this Act, the parent that takes care of the child is entitled to get child support. All the paper work with respect to child support is done by the child support agency. The amount of child support agency is also decided by the child support agency according to this law.

The main objectives of this Act are:
  1. To assure financial support for the child
  2. Level of support is determined on the capacity of the parents, should be according to the fixed standards, the rights of the children for better support as if living with both the parents.

Child support Registration and Collection Act of 1988

The Child support Registration and Collection Act came into existence in 1988. This act is regarding the payment of child support. The main objectives of this act are:

  1. Parents are liable to make child support for the financial support of the child
  2. Parents should make the support payments regularly and at definite periods
  3. It covers international arrangements regarding child support, parentage, etc.

According to this Act, the liabilities of the child maintenance lie with the Parent or step parent of the child. The payments are as under the court order or a maintenance agreement maintained in the court register.

Family law Act of Australia:

The Family law Act of Australia mentions that it is the joint responsibility of both the parents to support their child. It is applicable even if they have separated or have started a new family. The sections, 61 B to 61DB of the Act relate to all the duties and responsibilities of the parent towards the children.

The child support Act for same sex parents

The Family law of Australia also has some provisions of same sex parents and child support. New parentage laws are recognized for same sex couples with children. These couples are recognized as parents according to the Family Law Act of 1975. Lesbian couples are recognized as parents of the child according to the section 60 H of the Family Law. It includes parentage in cases like Surrogacy arrangement, adoption, assisted conception, etc. It recognizes the couple as parents if:

  1. The child is born with an conception procedure
  2. The couple was in De facto relationship during the birth of the child
  3. The couple agreed for conception

The Australian child support Acts makes sure that the child support is paid regularly. It also puts down the circumstances for child support and the modes of payments of child support. It also gives details of procedures in case there is a default of child support payments in Australia.
