What is Family Court


play in our society. Family Courts are special courts that deal with matters related to Family Law.

In UK, the High Court of England and Wales (EWHC) has a Family Division that deals with matters that come under Family Law. The High Court’s Family Division has jurisdiction to hear all cases related to divorce, children, and other family related matters.

In event of a divorce if the couples are not able to decide regarding the custody of children, child support, alimony, visitation, parental responsibility, and so on, then the right place to approach is the Family Court.

Most of the couples get jittered at the name of approaching the Family Court. They hardly know what is Family Court and how can it help them. People think that applying to a Family Court is going to be tedious and complicated. Well, there is some truth in this because the Family Court takes time in pronouncing the decision and also requires a lot of effort on the part of the applicants.

If you do not want to approach the Family Court to solve your family disputes you can also seek family mediation. Family Mediation is a process where the family disputes are settled out of the court in a peaceful manner with the help of a mediator. There are special family mediators for divorce, custody, child maintenance, alimony, and so on. Mediation is a good way to solve family disputes as they are less time consuming, affordable, and simpler.

In fact Family Courts encourage the couples to settle their dispute through mediation. Whenever the couple approaches the court the judge first asks them to solve their problem through mutual agreement or mediation.

However in case you have decided to approach the court for mediation it is better to take professional help. There are a number of law firms specializing in family law that can help you complete the paperwork required for filing the case and taking it further.

The Family Court can issue the following orders when it comes to children after divorce:

Residence Orders: Residence Order is issued by the court to announce as to whom the child will live with. Generally the parent who gets the Residence Order has the custody of the child.

Contact Orders: Contact Order is issued by the family court to establish contact between the non custodial parent and the child. The order may also have various details of visitation like date, place, duration etc.

Parental Responsibility: Parental Responsibility Order is issued to both of the parents. The non custodial parent also has the equal right to take important decisions regarding the child and should be informed about anything major related to him or her. Except in a few cases the court grants Parental Responsibility to both the parents.

Care Orders: A Care Order places a child under the care of a local authority because the child is deemed to be unsafe otherwise. The local authority acquires the Parental Responsibility in such condition.

After going through the above mentioned Orders one can have an idea of what is a family court and what all comes under its jurisdiction.
