Who gets CustodyFierce custody battles are common in UK where number of divorce is ever rising. Who gets custody ends up in a severe battle of egos. In most of the cases both the parents want the custody of the child and are ready to fight a court case for that. When couples with children get divorced only one parent gets the legal custody of the child. This implies that for most of the times the child will stay with the custodial parent, but the other parent (non custodial), will get other rights like Visitation, Contact Orders, Parental Responsibility and so on. The parent who gets custody receives a certain amount of money on a regular basis from the non residential parent as part of the financial responsibility of the child. This is known as child support. Divorce is an emotionally taxing exercise. Especially for couples who have children parting ways becomes a little complicated. The truth is that although they want to get separated from each other, neither one wants to give away the child. This emotional situation gets even more heated when the couples become egoistic about possessing the child. Both vie to prove themselves as the best parent without realizing what the child’s dilemma. After looking at the divorce cases and child custody battles it can be concluded that in most of the cases the mother gets the custody of the child. It is a well known fact that mother is the person who takes care of a child’s basic needs. Young children find it hard to live without their mother and this is the reason why court pronounces cases mostly in favor of the mother. There are two ways to get the custody of the child after divorce. Either the couples can get into a mutual agreement as to who will take the legal custody of the child, or fight the custody battle in the court. Most of the times it is justified for the mother to take the custody of the child and the father also agree with this. However, a case where the father does not want to give up his stake on the child, or does not consider the mother fit to take care of the child, he approaches the court to decide who gets custody. The court decides the custody of the child on the basis of a number of factors like:
Whoever gets the custody of the child, the financial responsibility of bringing up the child has to be shared by both the parents. Thus if the mother gets the legal custody of the child, the father pays child support as part of the financial responsibility. The parent who gets custody may be the resident my get to spend the maximum time with the child but the other parent also stays connected with the child by getting Contact Orders, Parental Responsibility Order, Visitation Rights, and so on.
