Tennessee Divorce Support

Divorce support issues are settled at the court during the divorce litigation if there is no pre nuptial agreement between the spouses regarding the support issues. Whether it spousal support or child support or distribution of property all the aspects of the Tennessee divorce support is ordered by the court as per the state statutes. While deciding on the divorce support issues the court also considers different aspects and related factors that give a fair idea of the requirement and earning resources of the parties involved in the case. As these circumstances are unique for each couple the verdict related to the Tennessee divorce support also differs from case to case. The court after declaring the divorce support also retains the right to modify the support in future if the circumstances change or either of the parties fails to abide by the ruling of the court.

Tennessee spousal support – Spousal support is given by one spouse to the other to support the living of the recipient. Divorce support is not a mandatory support for all the divorce cases. It is the court’s discretion to award the support in favor of either of the spouse who is financially weaker or unemployed. In the state of Tennessee the spousal support is given by the court according to the Tennessee Code - Volume 6A, Title 36, Sections 36-4-101. The court decides on the nature of the support and the amount of the support on basis of different related factors including the following points in TN spousal support,

• Duration of the marriage.
• Age of the parties.
• Physical and mental health of spouses.
• Standard of living during the marriage.
• Actual requirement to maintain the living that standard of life.
• Income of both the parties from all the sources.
• Marital properties and separate property.

Tennessee child support – The child support issues are dealt by the court according to the Tennessee Code - Volume 6A, Title 36, Sections 36-4-101 and 36-4-501. In the state of Tennessee the child support is calculated on the basis of the Percentage of Income formula where the required amount for the support is applied to the percentage of the income of the non custodial parent. While deciding on the amount of child support the court considers the following aspects.

• Age and health of the child.
• Educational need of the child.
• If there is any special requirement of the child.
• Insurance cost of the child.
• Earning of both the parents.

Property distribution in Tennessee divorce – In Tennessee distribution of properties is done by the court according to the Tennessee Code - Volume 6A, Title 36, Sections 36-4-121. Being an ‘equitable distribution’ state all the marital properties in Tennessee is distributed equitably by the court between the spouses in a manner that is found justified after considering different aspects related to property, assets and income of the parties.
