Basic principle of financial settlement


A divorce always calls upon a monstrous task of managing all the things and dividing them up equally among the two. One of the basic things which need settlement is that of finances. Financial settlement must be done efficiently and in a fair and just manner. This is important as financial disputes are the cause of most misunderstandings among the couples after a divorce.

It is highly advisable for any couple to reach a mutual agreement before they apply for a divorce suit in court. This will not only help both the spouses be content in the division of assets but also help immensely in the time management of the divorce suit. A prior settlement in agreement to both the parties can help escalate the comfort during the lawsuit as the court will, after a brief scrutiny, accept the agreement. The agreement rules out any surprise verdicts on division of the finances and property as is the case with trials in court. Even after the agreement, if there is something on which you cannot agree upon mutually, you can always still call for a trial in the court.

During the settlement, some of the basic principle of financial settlement in a divorce which should be kept in mind includes:

  1. Settlement of Spousal Maintenance: If there are no children, then it may be advisable to call up on a spousal maintenance. This is usually not something that anyone who is getting divorced usually wants to pay, but is legally necessary to support the spouse who cannot support himself. It is in the interest of both the parties to settle upon the spousal agreement mutually.
  2. Child Custody Allowance: In case there is a child or children involved in the family, some kind of child maintenance will also be needed to be determined. It may be decided upon mutual agreement that the spouse who will take up the custody of the child will have an additional allowance for the maintenance of the child. If the case is that the child is in equal custody of the parents, then child support maintenance may also be distributed equally. The child custody, if cannot be settlement within among the parents themselves, can also be settled down in a court trial. In such case, the allowance may also be ordered by the court.
  3. Division of property and assets: One of the last, but certainly not the least, is the basic principle of settling up the division of property. Property, unlike the general perception, includes all the movable, immovable assets. It also includes any investments like shares, loans, debts, pension, etc. which are acquired during the time of marriage. It is important to stay calm and composed during the process. In a courtroom settlement, the spouse who has the child custody and is less self-dependent is likely to get hold of more property.
