The Family Home


Divorce certainly is not a thing to which one looks forward to in a relationship but at times situations come to a dead end where the only option left to separate. Maintaining an individual’s saner life and making-up yourself mentally to take the decision of breaking the marriage and opting for legal divorce seems to be the best way out of the situation. These are the times when a divorce might seem an end to itself but actually it is not. A divorce is a legal procedure and like all the legal procedures it has all the paper work and legality which tags along with it as formalities which are indispensable.

In a divorce, a formality which can take up almost all the time of the procedure is dividing up the assets and property in a just manner. The step not only eats up time but can also lead to heated arguments and aggravated tension scenarios among the couple and their families.

One of the most important real estate property which calls for a long debate and sentimental arguments is of course, The Family Home. It is the house which the couple acquired to live and develop a family into. The house shares the memories and the happy moments of a relationship. In case of a divorce between couples with children, the family home can be the holder of all the sentiments and joys attached with the baby. This home in most cases bears all the post marriage splendour and this is the home where the couples have made their own rules to live. All this nostalgia which fills up the house makes it a difficult argument to win for the possession of the family home in a divorce.

The couple can obviously not share the Family home and selling it off to equally share the income from it is also, in most cases, not a viable solution because of the tremendous emotional investment in it which does not get reflected in the selling amount. Quiet often, the couple is also not of the opinion to divide the house legally and take up their share as it would mean the happy moments visiting back but not in a manner which can be welcomed. It may house the passions and celebrations of a child birth or a promotion in a job, which will haunt both the spouses when the house is divided.

In all, the Family home needs to be dealt with care and attention. It is best to decide anything regarding the house after the initial tide of emotions has settled out and calmed down.

It is also advisable to take up the settlement in presence of a legal expert who is mutually trusted by both the spouses. The settlement should also be carried on by the elder family mediators who are reliable and trustworthy.
