What the court considers for a financial settlement
There might be n number of financial issues to resolve in a divorce case and each case is different with different circumstances and conditions. Here comes the fair play of the court. In each case, the court vests in itself a very high responsibility of being transparent and fair to each of the parties, i.e., both the husband and the wife.
The court considers following points for the financial settlement in case of divorce:
- Investment Claims: While approaching towards the settlement, the court would consider the net value of all possessions and property and then segregate it reasonably between the husband and the wife. In case of pension being vested in the name of husband, the court can consider sharing of pension as well.
- Maintenance: The court would consider into account maintenance of the wife. In such a case, husband can pay either the lump sum amount at once or can opt for the long term maintenance, whether for spouse or for the children.
- Child Support: The most important and obligatory consideration taken into account by the court is that of a child, if any. Financial settlement would be made in such a way that the child support income inflows. The court would keep it into account that the child suffers the minimum. Responsibility increases if the child is not yet an adult, i.e., if he has not yet attained the age of 18.
- There might be other factors that a court considers in case of financial settlement. These factors though don’t pertain to every case, but might somehow relate to each divorce case:
- The financial needs or requirements of each of the party which they currently have or are likely to have in the near future.
- Level of affluence benefitted by the family before the marriage broke off.
- Age of husband and wife and the length of marriage.
- Any disability or handicap, whether mental or physical suffered by any of the parties.
- Code of conduct and behavior of each of the parties towards each other.
- Whether any of the persons has contributed or will do so in the near future for the welfare of the family.
As mentioned above, these are just the few considerations taken into account by the court of law. These are not the rigid rules and a law which applies to one case, might not be suitable for the other. Therefore, the court plays absolutely fair and transparent in delivering its justice to both the parties.
