Can I divorce in England?
Getting a divorce in England or Wales is only applicable when you follow or in fact offer a pre-requisite for the separation petition to be filed in the court.
If you have any of the following conditions fulfilled, you may file a petition in the European court and ask for further proceedings:
- The couple should be habitual resident of England at the time of the divorce proceedings.
- One of the couple should be the habitual resident at the time when the trials start.
- The petitioner must be a resident of England from past 12 months, from the time the proceedings have started.
- The petitioner is domiciled in England and is living for past 6 months, before the proceedings have started.
- The respondents are domiciled in England at the time the proceedings have started and no other contracting state to the European convention has jurisdiction.
There is a step by step method followed by UK courts, which is as stated:
- File a divorce petition: Filing a petition includes giving details of both the parties in a document and the reason for seeking divorce. All these documents, with the certificate of marriage and the court fees, should be send to court for the divorce process to be started.
- Service of petition: After the papers have been filed, if the court is satisfied by the documents, it then issues a petition to the respondent, along with the form, to be filled and sent back to the court.
- Acknowledging service of petition: The respondent has to reply with the form in a week and tell that if he/she will negotiate or will solve the divorce in the court. If they want a dispute, then the other spouse should reply in a month as an answer to the petitioner filed case.
- Confirming the facts in your petition: In this step, the petitioner has to confirm all the facts in the petition filed earlier. The affidavit is signed and is signed with court with the acknowledgement of service.
- Procuring the provisional order: After receiving all the detail documents of both the sides, then the court announces the date on which the proceeding will be started.
- Application to the final order for the marriage: This application is to be filled along with the fees, only then the divorce will be granted. There is a time of three months time, in case the petitioner fails to apply.
- Receipt of the final order: Only after the order is the passed by the court, it is then sealed and the couples are divorced.
