Does it matter who divorces whomA divorce petition is filed in the court as an application for separation, which is the first document presented by the party seeking divorce. Well, in such a matter, it does matter, who sends the petition to whom, because the spouse receiving it, is at a lot of disadvantages. Firstly, you may be asked to pay the fees of all the legal procedures of the divorce. Though it is not valid in the family justice system but as an old court principle, if you prove your case in court, then you get all the costs and expenses. This can be settled between both the parties, if they both talk it out of sharing the legal expenses, so the other does not seek any court order asking for finances against the spouse. Sometimes, there might be legal allegations of an unreasonable behavior against a spouse, which may be upsetting for the person and his family. Such allegation might ruin the exact thing in the petition as reason for the split, which may be untrue. All these should be dealt with negotiation first, or you can file the answer in the court and force a compromise, over this issue. If you can prove it, by investing a lot of time and money, you can put down all the facts and show that you are not guilty. The main feature of being divorced is what they can do to the other spouse in the matter of finances and children. These are critical issues which need to be resolved at an internal level. The property, family home, joint accounts, pensions, and insurances , are some of the issues which will be debated over in the court and the party who has filed the petition, might not easily do a 50-50 split, instead would ask for a compensation and finances for rest of the time. If children are involved, then there are emotions, which take the call, instead, at least this should be parental decision taking child’s welfare into consideration and decide best for him and his future. The child’s custody should be the priority and it should be consulted with the family or in case of indecision with a child psychologist. To avoid all these allegations, the partner should offer a sight to the petition send by the husband or wife, before it is send to the court, so that any matter which is publicly harming and gives distress must be resolved outside the court or compromised, this comes under the resolution of first code of practice, so all these can be prevented and the difficulties can be minimized.
