Legal Aid in England and Wales


Divorce in England and Wales is granted on the basis of the irrevocable collapse of nuptials. When the two believe that there is no future scope at all, the court accepts the petition for divorce. Who finances the divorce case?

The government provides sponsorship only in case of your legal disability. Therefore, availing legal aid is a complex and tedious process. Legal assistance is provided with regard to your income limits. The eligibility for availing the legal abet is decided by your solicitor or adviser. He decides on whether you are eligible, and you will be told without delay once you are evaluated.

As mentioned earlier, availing the legal aid is a difficult task and it can sometimes be lengthy as well. Here are other complications attached to it. Once you are over with your case, you need to pay back cost to the Legal Services Commission (LSC). In case of repayment, the money you get from the financial settlement of your divorce first goes to the LSC and after the final settlement; the left over amount is given back to you. It is mandatory to note that these rules are flexible subject to a few exceptions.

Receiving benefits from the National Asylum Support Service (NASS) acts also as an advantage to avail legal aid. Your legal adviser or solicitor can guide you better in such cases. Once you are liable to receive financial assistance from LSC, you don’t need to worry about the finance. LSC pays your lawyer for bills. The funding by LSC is supported by the Access to Justice Act 1999.
