Separation of the husband and wife in a legal marriage is a divorce which usually ends their relation.   1. First of all, the couple can give an application in the court, for a divorce, and then they can hire a solicitor for legal proceedings.
  2. You may file all the legal documents with the application, such as an affidavit, certificate of marriage, reason for the breaking up of marriage. In addition to it, other possessions you own with the spouse jointly or on your own name should also be taken into consideration.
  3. The solicitor will guide through the proceedings and then after it, if the court is satisfied by the reason of breaking up, other settlements and agreements, the divorce will be granted.

Though, both the spouses have to hire a solicitor, to make them go through the proceedings of the court, your agreements will help him keep the things directly in the court without discussion on them and any court order will not interfere in your personal decisions. Reaching agreements prior to the filings can make the process smooth as the mutually agreed upon division is usually accepted by the court after the judge goes through the list to check that the division is just and equal. This can happen even at a single session. This will also save you from a public display of the proceeding and you may get along with your life ahead, without being asked any question by the solicitor, judge or anyone close, as the couple already has decided on their respective shares.
