What is Divorce Arbitration and its Advantages and Disadvantages


Divorce Arbitration refers to out of court settlement rather we can say that the divorce case is presented to a neutral party called an arbitrator who act like a judge and has the power to take a final verdict. The arbitrator can be former judge or matrimonial lawyers. The arbitrator can compel both parties to accept his verdict. The decision can be binding or non-binding, in binding decision both the parties are bound to the verdict but an appeal by proving that arbitrator was unfair or had exceeded arbitrator authorities whereas non-binding decision one can appeal the verdict and the final outcome can remain the same or may favors the other party.

Unlike a mediator, judgment of an arbitrator may be acceptable or not, selecting an arbitrator is critical job. Generally wife and husband take decision on which the arbitrator will be and set up the process of how the arbitrator will be selected if they cannot agree on a judgment. Both parties can submit a list from which the judge chooses. Whatever the process be the arbitrator will act like a hired judge although not required to be a lawyer.

This service is paid service and both the parties divide the share of cost accordingly. Arbitrators are often needed when parties doesn’t agree on one issues or other which led to long divorce process.

Advantages of Divorce Arbitration

Time period: It can often take many months or even years to have outcome of a divorce through the court because of lengthy spaces of time between each hearing and even appeals after a decision has been made. Arbitration speeds up this process because of less chances of appeal to any decision made .Secondly there are more arbitrators than judges available, therefore your case heard more quickly.

Expenditure: Due to the fact that divorces through the court often take such a long time, which means costing a lot of money. In arbitration parties will not have endless hearings, no lawyer which will dramatically decrease costs for both of parties.

Flexibility: The arbitrator has more flexibility judge in making decision that means each party can tell their side of the story for the arbitrator which can lead to a fast and acceptable agreement between both parties.

Disadvantages of divorce arbitration

Less Appeal: In arbitration decision there is usually less appeal. Once a decision is made, it is in most cases final because of flexilablity.

Does Not Have To Follow Divorce Laws: Arbitrators are not bound by the divorce laws of the judicial system, they make whatever decision they deems best based on their judgment.

Accordingly both parties should decide if divorce arbitration is something they would like to try if so, then bring it up to the other party. It may be worth the time and cost savings for both of parties.
