What is the role of solicitor in divorce mediation?
A divorce case shows you tough times but settlement after a trying divorce is not impossible. The couple separating their lives from each other may suffer a lot during and after the divorce proceedings but this settlement comes as a kind of compromise for falling apart from the relationship they once shared. A divorce settlement may include issues like financial settlement, family home, custody of children, children support, spousal maintenance etc.
During the process of divorce, a settlement is one in which both the husband and the wife have mutual consent. Though if both parties hire a solicitor, they first try and act and mediate between both the spouses.
The act of mediation between the partners is of great benefit to the so-called couple and their solicitors.
- Negotiation works when both of them sit and decide what step to take and how to divide their belongings.
- If the two agree over sitting and dividing their assets by listing and sharing whatever they think suits them best, it will ultimately help them save a lot of time, money, and mental stress. Because, if there be any disagreements, they will reach court to be settled. The legal trials over such cases can involve a lot of time which will be spent on collecting evidences and arguments, etc in addition to the added expenditure on lawyer, court fee, etc.
- Both the spouses should also take the help of financial analyst who can help in division of property, assets, equity, investments, shares, mutual funds, insurances and bank accounts.
- If there is any joint debt, against the couple, they should rather talk it out before it is taken to court for resolution. Both of them are equally liable and should re pay it together or make monthly installments to the firm.
- In case, only one spouse has a loan on his name, then he has to take full responsibility of paying it back to the company. If during or after the divorce, the person fails to make payments, the firm will definitely try to contact the other, so in that case, it should be the other partner who can pay it back if his/her finances are fine. This can also be agreed upon through a mutual discussion.
- In case of child’s involvement, the child’s interest and welfare should be kept in mind and then the child custody should be decided. Both the parents have to pay for the child support and maintenance for the living. Visits to the child can be decided and they can be changed in future taking circumstances into account. The spouse having the child’s custody should let the other parent meet without any interruption, till the time the other spouse is not exceeding the duration decided by the court.
