However the more common forms of a separation agreement without any court interference is whereby the couple agree beforehand about any financial agreements, the children and the planned divorce. This separation agreement has a softer tone than that of legal separation agreement. Separation agreement will bind both parties until the divorce commences. During this time the couple can ask for the courts to make an order confirming the terms of the separation agreement. If you and your spouse are thinking of seeking divorce, a separation agreement can be a good test before you decide whether or not to divorce. It will also provide the children with time to adjust to the new arrangements without any anger from any of the parents.
