Which court should handle my divorce ?


“A marriage sets things upright and a divorce spoils it all” - one of quotes like these, actually establish the basic facts of separation of a husband and wife. While divorce is an upsetting time for the couple, it’s more like a misery when the two are in different countries. One of the major issues faced by the couple who are far apart is where to file a divorce and which court trial to seek. In cases, when the husband and wife are living in different countries, or basically belong to two different states or countries, or in extreme cases, come from different religious backgrounds, and want a legal separation, which jurisdiction they should go for is an important issue.

  1. If the petition is filed in one of the abroad courts by one of the spouses, it is rather an expensive and difficult thing to deal with these cases, outside your home and country with no extra knowledge of the new laws and rules. A normal tendency is to file a petition where your case is favored or it is strongest against the other party.
  2. Simultaneously, if both the spouses have filed a petition in their own states or country courts, the first question arises, where the proceedings will be held? To this, there should be a choice for a legal jurisdiction. Moreover, these cases have different rules of resolution in which both the cases are studied, negotiated with both the partners and then decided where the proceeding will begin.
  3. If one of the partners proves their case on the right side with an established reason for their separation, he/she can put on stay on the petition filed in the other country, so the trials can be held at the other place.
  4. If the wedding involved a pre-nuptial agreement and a spouse wants to divorce the other individual, he can file the case in that state or under law, in which these documents are considered as evident. So, there case would be stronger than the other individual.
  5. If there is custody of children as the main issue, the court takes the interests and welfare of the child as a priority. The fact is given due respect that which of the parents can keep the child safely and give him a comfortable living. Some of these matters worsen when religions are involved out of which some of them follow conservative laws.

So, before filing a divorce case, in your states or other, focus should be on the laws and the place which should favor you in the split, if you want true, equal and unbiased judgment.
