Legal fees also consist of attorney’s fees. Before understanding about the payment of your legal fees, it is important to understand what is attorney’s fee. When both the parties don’t strike a compromise, in such a case you need to hire a solicitor or an attorney to fight your case in the court. No doubt, these costs are high since attorney represents your case in the court. These costs depend upon the location and the requirement of the attorney.

If we talk about Florida, A Florida divorce court may order one party to pay the other for the disbursement of realistic attorneys’ fees and costs sustained in the suspension proceeding.

The award of attorney’s fees and costs is within the discretion of the court and a party cannot always trust on receiving an award. Some of the common payment solutions or ways are described below:

  1. A general Rule- a general rule says that both the parties need to pay for the legal fees. In this case, both the husband and the wife are solely responsible for paying their own fees.
  2. Judicial Exception- each case is different and exceptions are always there. If a spouse is deemed to prolong the proceedings of the court or is engaged into other inappropriate conduct, then a judge may order a spouse to pay at least some share of other spouse’s solicitor’s fee.
  3. Agreement- in case of financial settlement, one of the partners might agree to partly or fully pay some of the attorney’s fees incurred by the other partner.
  4. Legal Aid- the last of all resorts is the legal aid. Legal aid, in simple words, means when government provides financial legal aid to you, when you are unable to afford it. But this assistance is cause to undergo the proof and merit of your case. The government provides sponsorship in case of financial disability but availing the legal aid is a difficult task and it can sometimes be lengthy as well.
