Quick divorce in New York

Divorce laws changes with the state. Every state has its own divorce rules, regulations and guidelines. One can apply for a fast divorce in Nevada, Dominican Republic or California. But getting a quick divorce in New York is bit difficult.

Quick divorce generally results, when both the parties go for a no-fault divorce or an uncontested divorce. In a no-fault divorce none of the parties are faulty or responsible for the divorce. But the law of every state doesn’t allow this. New York is one of them.

In New York there are six grounds for divorce. Four of them are based on the “fault” of any one of the parties and it includes inhuman and cruel treatment, imprisonment for at least 3 years, adultery and abandonment for 1 or more years. Another ground for divorce is that, couples have to live apart for a year under a separation judgment granted by a court. The only no-fault ground that the New York divorce law allows is when the couples undergo a separation agreement to live apart for one year.

• Consult a good lawyer. Divorce laws in NY are quite complicated. If you don’t have a sound knowledge about the legal procedures, it can take years to get divorced and lot of money will also be wasted.
• Talk to your spouse about the divorce complications and ways to avoid it. Try to reach to an agreement on divorce related issues like assets and children.
• Go for a legal separation. This will help you to get divorced after one year.

Residential requirement:

To get a divorce in NY the couples must fulfill the residential requirement. According to this:

• Either of the divorcing couples must have been a resident of NY for at least 1 year before preceding the divorce case, or
• Both were married in the state and any one of them is a resident of NY for the past one year before beginning of the action, or
• The grounds for divorce had taken place in New York and either of the party are a resident of the state for past one year, prior commencement of the case.

In order to get a quick divorce in New York one must go for a no-fault divorce. For this you have to fulfill the residential requirements and need to sign a separation agreement according to which none of the spouses are at fault and both are willing to get divorced.

All your matters related to divorce like property, alimony, child custody or visitation (if any) must be settled out of court. It will take only 30 days to process your case after filing if everything is in order. Otherwise a contested divorce case can take two to three years or even more depending on the complications involved.

Divorce laws and grounds are very strict in NY. The state does not allow unilateral divorce. For dissolution of marriage, it is necessary to prove the grounds in this state. But if both parties are in agreement, quick divorce in New York is possible.
